Portland Cement Zambia Case Resolved After Ten Years; Ownership Goes To Dr. Rajan Mahtani

Dr. Rajan Lekhraj Mahtani is a reputed businessman in Zambia known for his straightforward business practices and several successful ventures including Mahtani Group of Companies, Finsbury Investments and Finance Bank Zambia. Another business entity belonging to Dr. Mahtani is the Portland Cement Zambia factory which remained disputed for more than a decade. According to reports, a case was registered by Dr. Rajan Mahtani more than ten year ago at the Lusaka High Court. In this appeal, Dr. Rajan Mahtani claimed that his factory was unethically taken over by force. To prove his ownership, several evidences and testimonials were shared by Dr. Mahtani. After more than a decade of case proceedings, justice Nkonde on behalf of the Lusaka High Court announced the final decision on the case. However, this decision was touted as a controversial decision as Justice Nkonde declared Ventriglias as only shareholders of the Portland Cement Zambia limited despite their lack of evidence.


This unethical decision prompted Dr. Mahtani to re-appeal to the higher Court of Appeal. The judge at the higher Court of Appeal was justice Mwinde who declared the final verdict on the case on 31st January 2019. According to the final verdict, it was found that Dr. Mahtani had made a payment of one billion kwachas to the Portland Cement Zambia limited in the year 2005. This official transfer gave Dr. Mahtani majority shareholding ownership over the factory. The details were further found in the shareholders’ agreement from 2007. Based on these evidences, justice Mwinde from Court of Appeal announced Dr. Mahtani as the majority shareholder and legal owner of the factory.
