After the misdirected and unethical decision from the Lusaka High Court judge on Zambezi Portland wherein Ventriglias were announced as only shareholders of the Portland Cement, Dr. Rajan Mahtani took the appeal to the higher Court of Appeal. On 31st January 2019, justice Mwinde dismissed the findings of fraud by judge Nkonde and announced that Dr. Rajan Mahtani is the majority shareholder and legal owner of the Portland Cement Zambia factory. After an application for embodiment order by Finsbury Investments, judge Mwinde from higher Court of Appeal evaluated this decision. On 29th Match 2019, judge Mwinde announced that the amount payable against majority shares owned by Finsbury Investments would be K580,000 as opposed by K580 million claimed by the Ventriglias.
More than 15 months after this definitive verdict from the Court of Appeal, the Ventriglia family once again decided to disrupt the Zambezi Portland business operations by challenging the Court of Appeal’s verdict on Zambezi Portland. This claim was established at the Supreme Court and a bench of three judges evaluated the validity of the appeal. After evaluation, it was found that the Ventriglia family did not fulfil the legal requirement of registering its appeal which requires claims to be registered within 14 days of the court verdict against which the challenge has been identified.
As a result, the Supreme Court bench came to the conclusion that the claim by the Ventriglia family have no validity and reliability and therefore, was rejected by the Supreme Court. With this rejection, it is now further confirmed that Dr. Rajan Lekhraj Mahtani is to remain the majority shareholder as well as legal owner of the Portland Cement Zambia factory.
