Higher Court Of Appeal And Justice Mwinde Comes To Rescue Of Portland Cement Zambia


Judiciary system of any nation has a critical role in maintaining law and order and transparency in the nation. That said, majority of the emerging and developing nations face significant issues in terms of maintaining judicial transparency mainly due to the widespread corruption and unethical practices. Dr. Rajan Mahtani is a noted businessmen from Zambia and has established his name as one of the most transparent and ethical businessmen in Zambia. Despite his reputation, he was failed by the increasing corruption and unethical practices at the Zambia nation. First, his Portland Cement Zambia factory was unethically taken over by force. Then Dr. Rajan Mahtani approached the Lusaka High Court with all evidences and testimonials hoping to get a quick justice. However, the same did not happen and Dr. Mahtani had to face significant roadblocks in getting verdict. The final verdict came more than a decade later and was given by justice Nkonde. However, the final verdict announced Ventriglias as only shareholders and as a result Dr. Mahtani was left with no option than to approach the higher Court of Appeal.

Thankfully, the judge at the higher Court of Appeal looked into evidences and testimonials which were ignored by the previous judge. Among those evidences, the most important was transfer of one billion kwachas from Dr. Rajan Mahtani owned Finsbury Investments to the Portland Cement Zambia limited. This transfer of sum gave Dr. Rajan Mahtani ownership of 58 percent Portland Cement shares which was further confirmed from the original shareholders agreement established in the year 2007.

Based on these evidences, justice Mwinde announced Dr. Rajan Mahtani to be the actual owner of the Portland Cement factory.
