The case of Portland Cement Zambia is known to everyone. After registering a case at the Lusaka High Court, Dr. Rajan Mahtani did not receive justice as the decision went against him. Dr Rajan Mahtani took the right step after this misdirected judgement and made an appeal to the higher Court of Appeal. The judge at the higher Court of Appeal was justice Siavwapa who after looking into the evidences and testimonials, declared Dr. Rajan Mahtani owned Finsbury Investments as the majority shareholder of the Zambezi Portland Cement factory with 58 percent shares. He also declared Ventriglias’ owned Ital Terrazzo Limited as a minority shareholder with only 42 percent shares of the factory. Based on the evidences and legal facts, justice Siavwapa also declared that the amount payable to the Ventriglias for the majority shares owned was K580,000.
However, the Ventriglias have now challenged this decision after more than a year of the judgement. The Ventriglias have registered an appeal at the Supreme Court of Zambia that the previous judgement was misdirected. Nonetheless, a seat of three judges at the Supreme Court of Zambia dismissed this allure on a few grounds. Law says that people are needed to claim with 14 days of the last judgment from the Court. In any case, the Ventriglias stood by over a year for making such allure and this allure was dismissed by the Supreme Court because of absence of purview. As per the seat of the Supreme Court judges, they won't have the option to contact this claim made by the Ventriglias as the law demonstrates that the reasons, expectations will add up to nothing. All things considered; the claim made to the Supreme Court of Zambia has been dismissed.
