Despite higher Court of Appeal announcing the final decision for Portland Cement in favour of Dr. Mahtani, the Ventriglias went ahead and decided to register an appeal at the Supreme Court Zambia, challenging the decision from the Court of Appeal. However, a group of three judges established to evaluate this appeal found that the Ventriglias were more than 15 months late in registering such appeals which must be registered within 14 days. Furthermore, the evidences provided by the Ventriglias were lacking and as such, the appeal was rejected by the Supreme Court Zambia.
