Dr. Rajan Mahtani is one of the most transparent and authentic businessman in Zambia. He is a firm believer in the Zambian justice system, which did not fail him. Dr. Rajan Mahtani once again wins the ownership of Portland Cement Zambia. It was an indirect effect of the bizarre claim by the Ventriglia family. The Ventriglia family, after more than 1.5 years of higher Court’s decision, appealed against it. This appeal was made at the Supreme Court Zambia. The Ventriglia family claimed that the decision from the higher Court of Appeal was wrong. The Supreme Court established a bench of three Supreme Court judges for evaluating the case. These included judge Mumba Malila, judge Royda Kaoma and Judge Michael Musonda. A critical technical requirement was identified which the Ventriglia family failed to comply. All claims against previous court decisions must be made within 14 days of the court decision itself. Since the decision from the higher Court of Appeal came on 31st January 2019, this means the Ventriglia family should have made their appeal within 14 days of the above date. However, the Ventriglia family made their appeal only after 1.5 years of the decision. This clearly violates the most important technical and legal requirement for accepting the case. Furthermore, the judges found the claim by the Ventriglia family controversial and questionable. The judges also confirmed that their decision on the case would be similar to what higher Court of Appeal gave on the Portland Cement Zambia case.
As such, the Supreme Court Bench effectively rejected the claim by the Ventriglia and the decision from the higher Court of Appeal, therefore, remains same.
