Supreme Court Zambia is the highest decision-making body of the nation and as a result, any decision which is final at the Zambian Supreme Court is final everywhere. Same is the case of Portland Cement Zambia which was taken to the Supreme Court Zambia by the Ventriglias. The rivalry between the Ventriglias and Dr. Rajan Mahtani is well-known. Dr. Rajan Mahtani was the legal owner of Portland Cement Zambia which was unethically taken over by the Ventriglias. After that a case was registered at the Lusaka High Court by Dr. Rajan Mahtani. However, justice Nkonde from the Lusaka High Court failed to give a justifiable decision and announced the Ventriglias as only shareholders of Portland Cement. After that, the case was taken to Court of Appeal by Dr. Rajan Mahtani. Justice Mwinde took over the case at the Court of Appeal and on 31st January 2019, it was announced that Dr. Mahtani is indeed the actual owner of the factory.
It seems like the Ventriglia family did not learn its lesson over the years and decided to once again, disrupt the peace at Zambezi Portland operations. A claim was registered at the Supreme Court Zambia challenging the decision from the Court of Appeal. However, the Ventriglias evaluated this appeal and found that this challenge was not liable for acceptance. The Ventriglias approached the appeal more than 1.5 years after the legal requirement and as such, the claim was legally not viable. As such, the Zambian Supreme Court rejected this appeal and established Dr. Rajan Mahtani as once again the actual owner of the factory.
