The latest claim by the Ventriglias challenging the decision of higher Court of Appeal on the Portland Cement Zambia case can only be described as a hopeless attempt towards capturing the ownership of the factory. According to the final decision from the higher Court of Appeal which was given on 31st January 2019, Dr. Rajan Mahtani is to remain the majority shareholder and legal owner of the Portland Cement Zambia factory with 58 percent shares. These shares are held by Finsbury Investments wherein Dr. Rajan Mahtani holds the position of the chairman. Essentially, justice Mwinde on behalf of the higher Court of Appeal reversed the decision by the Lusaka High Court. It should be noted here that the Lusaka High Court was condemned for giving a controversial decision on the Portland Cement Zambia case in which the Ventriglias were announced as only shareholders of the Portland Cement Zambia.
After more than 1.5 years of the decision from the higher Court of Appeal, the Ventriglias again made a controversial claim in which they challenged the decision from the court. This claim was made at the Supreme Court Zambia and to evaluate this claim, a bench of three Supreme Court Judges was established. After evaluation, the bench found that the claim cannot be accepted as it not legally viable. The law suggests that any claims or challenge against a previous court decision must be made within 14 days of the judgement itself, which in this case was 31st January 2019. As such, the Supreme Court judges did not have jurisdiction over the case. It was also found that the circumstances surrounding the claim were controversial and as such, this claim was rejected by the Supreme Court
