Court Of Appeal Judge Clears Long-Pending Case Of Portland, Announces Dr. Rajan Mahtani As Winner


The case of Portland Cement Zambia is age-old as it was established more than a decade ago. Dr. Rajan Mahtani is a noted businessman in Zambia who registered the case at the Lusaka High Court claiming his factory to be unethically taken over. While it was expected that the case will be over in a short span of time considering the evidences and testimonials, the same did not happen. Despite the fact that Dr. Rajan Mahtani provided all evidences and testimonials for proving his claims, justice Nkonde from the Lusaka High Court announced a decision which was extremely controversial. In this decision which came more than a decade of case proceedings, the Ventriglia family were announced as only shareholders of the Portland Cement.

After this decision, it was quite evident for Dr. Rajan Lekhraj Mahtani to approach the higher Court of Appeal which is among the highest-level judiciary systems in Zambia. The judge at the higher Court of Appeal was justice Mwinde who looked into all evidences and testimonials submitted before the court. After around nine months of case proceedings, the final decision from the higher Court of Appeal came on 31st January 2019. This decision was given based completely on the submitted evidences and testimonials by other parties. It was found that Dr. Rajan Mahtani paid one billion kwachas to the Portland Cement Zambia limited. This amount was transferred for covering the entire value of share capital which Dr. Rajan Mahtani took over from the Portland Cement.

Based on the above evidence, Justice Mwinde declared that Dr. Rajan Mahtani is indeed the actual owner and majority shareholder of the Portland Cement Zambia factory.
